As an employer, you have a legal duty to provide a safe workplace for your employees, so that you do not put their health at risk. This will involve ensuring that plant and machinery are safe. Raw materials and equipment are handled and stored safely. You must provide appropriate information, instruction and training and supervision to ensure safe working practices.
The Corporate Manslaughter Act came into effect in April 2008. Company Directors now face unlimited fines, along with imprisonment if found guilty in court of ‘gross failure’ of their management of health and safety procedures, which results in a death.
The new Health & Safety Offences Bill, soon to become law in 2009, was introduced by former Labour Minister Keith Hill. He said the Bill's aim was to "ensure appropriate punishment for those who are negligent or would seek to cut costs by infringing health and safety arrangements." The Bill will increase the maximum fine available in magistrates' courts from £5000 to £20,000 for most breaches. It would also make a custodial sentence an option for more offences.
The key to avoiding prosecution is simply to ensure that your company is following the relevant health and safety legislation. Everyone is facing tough times in business, but it is simply false economy to be just considering what health and safety will cost you, and ignoring the consequences of what it may ultimately save you.
